Press Conference: Spanish Ministry of Health taken to court over Mercury Poisoning
On Friday 15 February 2008, the Spanish associations AVA (Asociación para Vencer el Autismo1) and ANDECO (an association which fights to protect the environment through Ecotourism and fights on a range of health issues) in collaboration with ALDIS (Asociación para Prevenir y Sanar Enfermedades Infantiles2) and members of MERCURIADOS (Asociación Española de Afectados por Mercurio de Amalgamas Dentales y Otras Situaciones3) held a press conference in Barcelona, Spain, to announce that they will shortly be taking the Spanish Ministry of Health and Consumption and the laboratories responsible for vaccines to court.
The plaintiffs accuse the Ministry of having introduced mercury into its vaccination programmes and of permitting the unsafe use of mercury in dental fillings. They are demanding financial compensation for the damages caused to the victims. To date 50 people have joined the court case. They suffer from a range of disorders - including autism, chronic fatigue syndrome, intestinal candida, rheumatism and pernicious anaemia – all caused by mercury poisoning.
The press conference was attended by the major national media such as Televisión Española, Televisión de Catalunya, Tele 5, Com-Radio y Catalunya Radio among others.
The first person to speak was Marian Barnes, founder and president of ANDECO and herself a victim of mercury poisoning for 40 years. She explained that her association had joined the court case, among other reasons, in order to contribute to the United Nations Zero Mercury campaign. The UN have declared mercury to be a serious world health threat.
The next speaker was Ana Medina, president and founder of AVA, mother of a 20 year old autistic young man. He has mercury poisoning, as proven by multiple blood, urine and hair tests. This poisoning has triggered food intolerances, intestinal problems, chronic candida and sensory problems. He has improved enormously thanks to treatment with mineral and vitamin supplements, a diet which excludes all the foods he is intolerant of, plus chelation treatment to eliminate heavy metals. Nevertheless, he is left with serious long term effects which will incapacitate this young man for life.
The president of AVA explained the cause of the alarming increase in autism cases, as well as other child disorders such as attention deficit disorder. In recent years the number of child vaccinations has increased enormously: whereas in the seventies children received 3 vaccinations, this had risen to 22 by the year 2000. These statistics are alarming because mercury began to be used as a preservative in these same vaccines 4. Ana Medina completed her contribution with a quote from Bernard Rimland, the founder of ARI (The Autism Research Institute): “Sooner or later the truth will come out”
The next person to speak was Ofelia Tabares, president of ALDIS and mother of a 13 year old autistic boy who has fortunately made a significant recovery thanks to biological treatments and to chelation. She commented that the statistics show how childhood disorders have increased as a result of environmental pollution, poor diet and genetic problems, among other causes.
Then came the turn of Servando Pérez, president of the association MERCURIADOS, a university profesor of education and a student of medicine at the University of Sanitiago de Compostela. He has 4 mercury dental fillings and suffers from fibromyalgia. He started by pointing out that neither he nor any of the other speakers should be there, given that the mercury poisoning of which they are all direct or indirect victims could have been avoided.
He referred to the report of a World Health Organisation expert who states that amalgam should be considered an inappropriate material for dental fillings and should not be used with children or pregnant women. Furthermore, the same WHO doctor states that any doctor who is confronted with patients suffereing from auto-immune diseases or from illnesses which are unclear, should consider the mercury in dental amalgams as one of the possible causes. In Catalunya, the College of Dentists and Stomotologists has recommended that amalgam not be used with pregnant women or children. In Madrid, the city Councillor for Health has made the same recommendation.
The next speaker was Xavier Uriarte, doctor, rehabilitation specialist, European coordinator of the report “The adverse effects of vaccinations in Europe”, and president of the Liga por la Libertad de Vacunación 5. The doctor presented some shocking data, for example the fact that mercury was removed from animal drugs in 1996 but not removed from human drugs until the year 2000. Between 2000 and 2004, antiseptics and some eye washes which contained mercury were withdrawn from the market. In 2004, the drug companies began to manufacture vaccines without the mercury preservative but still with traces of mercury. This is still true today and continues to be a concern.
The final speaker was Felipe Holgado, the lawyer for the plaintiffs, with 20 years experience with medical cases. He pointed out that parents are not informed of the risks of vaccines, nor are dental patients informed of the toxicity of dental amalgams and the Minsitry of Health is responsible for this. He announced that the lawsuit is supported by a team of prestigious doctors who will review each of the cases. The suit will also count on a large body of scientific literature which discusses the toxic nature of mercury and its relationship with the problems suffered by the plaintiffs.
To the surprise of all those present, including the media, the final stage of the press conference was suddenly interrupted by an outburst from Doctor Muñoz Yunta, a neurologist and autism specialist. He called into question any relationship between autism and mercury poisoning and claimed that this relationship had not been proven scientifically. To which the lawyer, Felipe Holgado replied that nor had the contrary been proven scientifically: that vaccines and dental amalgams were not the cause of autism.
This was a desperate moment for the organizers who had dedicated months of work and a great deal of money to make the press conference possible and who suddenly saw the event being dinamited and sabotaged before their very eyes. However, a number of the organisations replied to Dr Muñoz Yunta until the situation calmed down - all of this duly recorded by the cameras and sound recorders of the media. After the altercation, Dr Uriarte commented that they would lose the lawsuit but at the very least it would serve to alert the whole world to the dangers of mercury. To which the lawyer replied “We will win!”.
Ana Medina who knew Dr Muñoz (who had provoked a number of similar altercations at a seminar organised by AVA ) asked him publicly if he belonged to the team of investigators into autism at the Instituto de Salud Carlos III, an institution which depends on the Ministry of Health, the defendant in this lawsuit. The doctor replied “yes” to which Ana Medina answered “Dr Muñoz, we therefore know who sent you here.” She then thanked the press for their attendance and brought the press conference to a close to applause from the audience and to the stupefaction of Dr Muñoz.
